What Is Heirs’ Property?

“Heirs’ property” typically occurs when a homeowner passes away without a clear estate plan or completed probate process, leaving property ownership shared among multiple family members. Over time, this can create legal and financial complications that make it difficult to:

  • Sell or refinance property

  • Obtain homeowner’s insurance

  • Access repair or improvement funding

  • Transfer ownership properly

  • Preserve generational wealth

Unfortunately, many families are unaware of these issues until they are faced with housing code violations, tax foreclosure risks, title problems, or disputes among heirs.
